VEKA Terms of Service

Last updated 25 October 2026

These Terms are an agreement between THEDAVEKA TECHNOLOGIES (CAC BN 9784117), “TheDaveka”, “we” or “us”, and the business that creates a VEKA account (“you”). By creating an account you accept these Terms and our Privacy Policy.

VEKA in plain words

  • VEKA is a virtual assistant that answers your customers and books appointments using the information you give it.
  • It always tells customers it is a virtual assistant, and hands over to you when it can't help.
  • You are responsible for your prices, services and hours being correct.
  • VEKA never holds money: customer payments go straight to your own Paystack account.
  • Cancel anytime. Payments are not refundable except where the law says otherwise.
  • VEKA is not for emergencies or medical advice.

1. Your account

  • You must be at least 18 and have authority to act for the business.
  • Give accurate information and keep it up to date.
  • Keep your password private. You are responsible for activity on your account, including by staff you add.
  • Tell us at once if you think your account has been misused.

2. What VEKA does

VEKA answers customer enquiries and makes bookings on your behalf, using only the services, prices, hours and policies you enter. It introduces itself as your virtual assistant, never pretends to be a person, and passes the conversation to you when it is unsure or when a customer asks for a person. Like any automated system it can make mistakes, so you should review bookings and messages in your dashboard.

3. Your responsibilities

  • Keep your prices, services, hours and policies accurate. Information VEKA gives customers from your settings is your information.
  • Have a lawful reason to hold your customers' data and follow the Nigeria Data Protection Act 2023.
  • Send promotional messages only to customers who opted in, and honour STOP requests (VEKA does this automatically).
  • Follow WhatsApp's Business and Commerce policies and the rules of any other channel you connect.
  • Do not use VEKA for anything unlawful, misleading, abusive or harmful, or to send spam.
  • Do not use VEKA to give medical advice or handle emergencies. VEKA directs anyone describing an emergency to call 112.

4. Payments from your customers

Customer payments are processed by Paystack and settled directly into your own Paystack account. TheDaveka never receives or holds your customers’ money. Where VEKA charges a fee on a payment, Paystack splits it off automatically. Refunds and disputes are handled through your Paystack account.

5. Plans and billing

  • Paid plans are billed in advance through Paystack. Prices are shown before you pay.
  • You can cancel anytime. Your plan stays active until the end of the period you paid for and you are not charged again.
  • Payments are non-refundable, except where Nigerian law requires a refund or where we could not provide VEKA for a sustained period for reasons within our control.
  • We will give at least 30 days' notice of any price change for your plan.

6. Third-party services

VEKA relies on services such as WhatsApp (Meta), Paystack and our hosting and AI providers. Their availability and rules can change, and we are not responsible for their actions. We work to keep VEKA available but do not promise uninterrupted service.

7. Data protection agreement

For your customers’ personal data, the following terms apply (NDPA section 29):

  • Roles. You are the data controller; TheDaveka is your processor and acts only on your documented instructions, given through your VEKA settings.
  • Confidentiality. Only authorised TheDaveka staff under confidentiality duties may access your customers’ data, and only to provide or support the service.
  • Minimal data. VEKA stores only a customer’s name, phone number and booking details, deletes chat messages after 30 days, and does not collect health details.
  • Security. We keep appropriate measures, including encryption in transit, access control, separation of each business’s data, and logging.
  • Sub-processors. You authorise the providers listed in our Privacy Policy. We give 30 days’ notice of any new one, and you may object by ending your subscription.
  • Transfers. Data may be processed outside Nigeria under NDPA sections 41 to 43, after removing direct identifiers where practical.
  • Assistance. We help you answer customer requests, carry out data protection impact assessments and meet breach duties.
  • Breach. We notify you without undue delay, and within 24 hours of confirming a breach affecting your data, so you can meet your 72-hour duty.
  • End of service. When you cancel, you may export your data within 30 days; after that we delete it, except records the law requires us to keep.
  • Audit. We provide the information reasonably needed to show compliance, once a year or after a breach.
  • Your warranties. You confirm you have a lawful basis to give us your customers’ data and that your prices and service details are accurate.

8. Intellectual property

VEKA, its software and the TheDaveka and VEKA names and logos belong to TheDaveka. Your business content (including your logo, services and prices) stays yours; you give us permission to use it only to provide VEKA to you.

9. Limitation of liability

To the extent the law allows, TheDaveka is not liable for indirect or consequential losses, such as lost profits or lost business, and our total liability to you is limited to the subscription fees you paid in the three months before the claim arose. Nothing in these Terms limits liability that Nigerian law does not allow to be limited.

10. Suspension and termination

You can close your account at any time. We may suspend or close an account that breaks these Terms, puts customers or the service at risk, or is required to be closed by law. Where possible we will warn you first and give you a chance to fix the problem.

11. Changes to these Terms

We may update these Terms. For important changes we will give at least 30 days’ notice by email or in the app. Continuing to use VEKA after a change takes effect means you accept it.

12. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. If a dispute arises, contact us first and we will try to resolve it informally. If it is not resolved within 30 days, either party may take it to the courts of Lagos State.
